Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and JobSight ("Company," "we," "our," or "us") regarding your use of the JobSight construction management platform and related services (the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Description of Service

JobSight provides a comprehensive construction management platform that includes:

  • AI-powered daily logging with voice-to-text transcription
  • Project management and tracking tools
  • Crew and equipment management systems
  • Automated invoicing and billing features
  • Client and task management capabilities
  • Real-time analytics and reporting
  • Mobile and offline functionality

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

Account Registration and Security

Account Creation

To use our Service, you must create an account by providing accurate and complete information. You may create an account directly with us or through supported social authentication providers (Google, Facebook, LinkedIn). You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Be responsible for all activities under your account
  • Notify us immediately of any unauthorized use
  • Use a strong password and keep it confidential (for direct accounts)
  • Comply with the terms of service of any social authentication provider you use

Authentication Services

We use Clerk as our authentication service provider to manage user accounts and security. When you create an account, your authentication data is processed and stored by Clerk in accordance with their privacy policy.

You may create an account directly or through supported social authentication providers (Google, Facebook, LinkedIn). When you use social authentication, you authorize us to access basic profile information from these services:

  • Your name and email address
  • Profile picture (if available)
  • Professional title (LinkedIn only)

We use this information solely for account creation and authentication. You remain subject to the privacy policies and terms of service of both Clerk and any social authentication provider you choose.

Account Eligibility

You must:

  • Be at least 18 years old or the age of majority in your jurisdiction
  • Have the legal capacity to enter into binding agreements
  • Not be prohibited from using the Service under applicable laws
  • Represent a legitimate business entity if creating a business account

Acceptable Use Policy

Permitted Uses

You may use the Service for:

  • Managing construction projects and related business activities
  • Creating and maintaining daily logs and reports
  • Coordinating crews and equipment
  • Generating invoices and managing client relationships
  • Any other lawful business purpose consistent with the Service's intended use

Prohibited Uses

You agree NOT to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service or servers
  • Use the Service for any illegal or fraudulent activities

  • Reverse engineer or attempt to extract source code

Subscription and Billing

Free Trial

We offer a 14-day free trial for new users. No credit card is required to start your trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.

Paid Subscriptions

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice to existing subscribers
  • You authorize us to charge your payment method for all fees
  • Failed payments may result in service suspension or termination

Payment Processing

We use Stripe, a PCI DSS compliant payment processor, to handle all payment transactions securely.

When you provide payment information:

  • Your payment data is transmitted directly to Stripe's secure servers
  • We do not store complete credit card information on our systems

  • We receive only transaction confirmations and necessary billing details

By providing payment information, you agree to Stripe's terms of service and privacy policy. You authorize us to charge your payment method through Stripe for all applicable fees.

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial months or unused portions of your subscription.

Data Ownership and Privacy

Your Data

You retain ownership of all data you upload to or create within the Service ("Your Data"), including:

  • Project information and daily logs
  • Client and crew data
  • Photos, videos, and voice recordings
  • Reports and generated content

License to Use Your Data

By using the Service, you grant us a limited, non-exclusive license to use Your Data solely to:

  • Provide and improve the Service
  • Process voice recordings for AI transcription
  • Generate reports and analytics
  • Ensure Service security and functionality

Data Security

AI and Voice Processing

Voice-to-Text Features

Our Service includes AI-powered voice-to-text transcription. By using these features, you acknowledge and agree that:

  • Voice recordings are processed by AI systems to generate text transcriptions
  • Transcription accuracy may vary and should be reviewed for correctness
  • Voice data is processed securely and not permanently stored
  • You are responsible for ensuring voice recordings comply with applicable laws
  • You have necessary permissions to record voices of others

Intellectual Property Rights

Our Rights

The Service, including its software, design, content, and trademarks, is owned by JobSight and protected by intellectual property laws. You may not:

  • Create derivative works based on the Service

Service Availability and Support

Uptime and Availability

While we strive to maintain high availability, we do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to:

  • Force majeure events

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBSIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Construction Industry Considerations

You acknowledge that the Service is a management tool and does not replace professional judgment, compliance with safety regulations, or adherence to building codes and industry standards. You remain solely responsible for:

  • Compliance with all applicable construction and safety regulations
  • Accuracy of project data and daily logs
  • Professional decisions based on Service-generated reports
  • Verification of AI-transcribed content

Termination

Termination by You

You may terminate your account at any time by canceling your subscription through your account settings or by contacting us. Upon termination:

  • Your access to the Service will end at the end of your billing period
  • You may export Your Data before termination
  • We will delete Your Data within 30 days unless legally required to retain it

Termination by Us

We may terminate or suspend your account immediately if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay subscription fees
  • Engage in fraudulent or illegal activities
  • Pose a security risk to the Service or other users

Indemnification

You agree to indemnify, defend, and hold harmless JobSight and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your Data or content uploaded to the Service
  • Your construction projects or business activities

Governing Law and Dispute Resolution

Dispute Resolution
